Maryland's New Personal Information Data Protection Statute: Understanding Your Computer Security Obligations After January 1, 2008

On January 1, 2008 most of the Personal Information Protection Act of 2007, 2007 Md. Laws Ch 531 goes into effect. In general, it requires all business entities that hold "personal information" to maintain reasonable security measures over the information, or risk violating the Md. Consumer Protection Laws. Maryland has finally followed the vast majority of other states that have adopted a data protection statute. Maryland's new law follows in many respects these other laws, but is much more business friendly than for example California's Data Protection Law.
Michael D. Oliver, an attorney with Bowie and Jensen LLC in Towson, concentrates his practice in transactional intellectual property matters, primarily in acquisition, protection and enforcement of intellectual property rights, computer and internet technology including domain names, trademark prosecution, copyright acquisition and enforcement, and advertising law including Lanham Act cases (false and misleading advertising, dilution, tarnishment). Mr. Oliver also has extensive experience in licensing of computer software, and licensing and ownership resolution of digital information on the internet.
Mr. Oliver has taught as adjunct faculty at the University of Maryland School of Law in the fall of 2000, co-teaching a course on "Introduction to Intellectual Property Practice". In 2004 Mr. Oliver co-taught "Cyberspace Law Seminar" at the University of Maryland School of Law. He is also a frequent speaker on computer law, the internet, and has given talks and seminars on advertising law and internet web pages, for among other organizations, the Maryland State Bar Association, the Maryland Institute of Continuing Professional Education for Lawyers, the Pennsylvania Bar Institute, and the Baltimore County Bar Association.
In January 2007, Mr. Oliver was recognized in the publication Baltimore Magazine SuperLawyers in the field of Intellectual Property Law and in April 2003 was recognized in Baltimore Magazine as one of Baltimore's Top Lawyers to Watch.
